Use of the Site constitutes express consent on your part (hereinafter: " User " or " Orderer ") to the aforementioned terms.

1.2.                  Use of the site is for lawful purposes only.

1.3.                  The purpose of the Terms of Use is to clarify the relationship between the website operator (hereinafter: "the Operator" ) and any person and/or entity who accesses the website and/or uses the Operator's services. Use of the website constitutes your agreement to these instructions and terms and your obligation to act in accordance with them. If you do not agree to all of the Terms of Use, do not use the website. The Operator reserves the right to terminate your use of the website if you fail to comply with one or more of the Terms of Use.

1.7.                  These Terms of Use constitute the entire agreement between the parties and supersede any prior agreement, proposal or representation, whether written or oral, regarding its subject matter.In any case of contradiction and/or inconsistency of any kind between the content of the site and the provisions of the Terms of Use, the provisions of the Terms of Use will prevail and apply.

1.8.                  It is hereby clarified that the operator may change and/or discontinue the website's activity in whole or in part at any time at its sole discretion and without any need for prior notice, without the user having any claims against it as a result.

1.9.                  The service is active 24 hours a day, 7 days a week, and can be used, including purchasing products, at any time. 1.11.              It is hereby clarified that the operator is not responsible for any use by users of the products sold on the site, and the user will have no claim against the operator for any damage caused to him and/or to any third party due to the use of these products. If necessary, a suitably qualified person should be consulted to verify the suitability of the product for the user.

 2.             Settings

"The content"It means the website, information about products, the online pages contained therein, the classification, arrangement and presentation of the information and any other form of illustration contained therein, in mailings and text messages.

 3.             Purchasing products and courses on the site

3.1.                  Various products are offered for sale on the site as detailed and appearing on the site. However, the operator may at any time discontinue the sale of certain products and courses, as well as add new products and courses and/or change the variety of products and courses offered for sale on the site, all at its sole discretion and without prior notice, and without the user having any claims against it due to the change as stated above.

3.2.                  Next to each product, its price appears, with the price including value added tax (VAT). However, the operator may change the price of each product at any time and at its sole discretion without the user having any claims against it for this. It is clarified that the determining date regarding the product price is the date the order is confirmed by the customer and not the date it is added to the shopping cart.

3.3.                  The Operator strives to ensure that all details, descriptions and images of the products appearing on the Site are correct. However, there may be bona fide errors with regard to the description or images of the products on the Site, and the appearance of the product appearing on the display of your device may differ from the actual appearance due to differences resulting, among other things, from the display settings and screen quality on your device. In any case, it is clarified that the images of the products appearing on the Site are for illustrative purposes only unless otherwise stated on the product page and do not bind the Operator in any way.

3.4.                  Because the product inventory changes from time to time, it is possible that a product that is ordered will not be available in the Operator's inventory at the time of ordering. Therefore, the Operator reserves the right not to provide the customer with the product as a result after contacting him within a reasonable time and informing him of the unavailability of the product in the Operator's inventory, without him having any claim against it for this, and will be entitled to offer him an alternative product that is in stock. If the customer has already been charged for ordering the product that is not in stock, the Operator will refund his money for ordering the product.

3.5.                  The operator reserves the right to cancel a transaction to purchase a product/course on the site if it becomes apparent that there was a bona fide error in the price of one of the products/courses on the site.And/or if the operator believes that this is a wholesale purchase and/or if the operator believes that providing the service/product to a particular user may harm the operator.

3.6.                  Advertising and/or displaying the products offered for sale on the site does not constitute a recommendation and/or encouragement to purchase them, and the operator is not responsible for any use by those ordering the products that will be purchased.

3.7.                  The prices of the products on the Site are not necessarily the same as the prices of the products that may appear anywhere else, including, but not limited to, other sales channels of the Operator. In any case, the prices appearing on the Site are the determining prices for any purchase of products made through the Site.

 4.             Placing orders, payment, product delivery and deliveries

4.1.                  Payment on the site can and will be made by credit card subject to approval by the credit card company. It is clarified that the operator may change the methods and/or means of payment and/or the methods of placing the order at any time at its sole discretion and without prior notice, without the user having any claims against it as a result.

4.2.                  The delivery of products purchased on the Site and for which the full consideration has been paid can and will be made by courier to the address entered by the customer at the time of purchase, subject to the delivery areas as they may appear on the Site from time to time and/or in any other way as appears on the Site. The Operator may change the delivery methods and/or delivery areas from time to time at its sole discretion and without prior notice, without the User having any claims against it in this regard.

4.3.                  Without derogating from the following, it is clarified that the delivery service is provided by a third party that is not under the operator's control or responsibility. Therefore, the operator will not be liable for any damage caused by any party that provides the delivery service as detailed above, including damage resulting from negligence.

4.4.                  Ordering products for delivery may incur shipping costs at a price that will appear on the site, which are in addition to the total cost of ordering the products. The operator reserves the right to update the shipping costs from time to time at its sole discretion and without prior notice, without the user having any claims against it for this.

4.5.                  ייתכנו עיכובים במועד האספקה עקב סיבות שאינן תלויות במפעילת האתר ואינן בשליטתה לרבות, אך לא רק, כוח עליון, מצב בטחוני רגיש באזור המשלוח, מזג אוויר קיצוני, מפגעי טבע (רעידת אדמה, שיטפון וכו'), מפגעים אחרים (כגון: שריפה, חסימות כבישים, מגיפות וכו') ועיכובים הנובעים משביתות ו/או צווים של רשות שלטונית שבגינן לא ניתן באופן זמני לספק את המשלוח, ולמזמין לא יהיו טענות נגד המפעילה בשל עיכוב כאמור. יובהר כי לא יהיה בעיכוב כאמור כדי לפטור את המזמין מחובתו לשלם בעבור הזמנתו.

4.6.                   המפעילה לא תהא אחראית בגין עיכובים שאינם בשליטתה ו/או מקורם במזמין, לרבות אך לא רק, קשיים ביצירת קשר עם המזמין או אי איסוף של מוצרים על ידי המזמין. עיכוב כאמור לא ייחשב כהפרת התחייבויות המפעילה לאספקת המוצר, ולא יהיה בעיכוב כאמור כדי לפטור את המזמין מחובתו לשלם בעבור הזמנתו.

4.7.                   במידה ותוך 30 ימים המוצרים לא יגיעו לידי המזמין שלא עקב מעשה ו/או מחדל של המפעילה (למשל לא ניתן יהיה ליצור קשר עם המזמין) אזי המזמין ייחשב כמי שוויתר על הזמנתו והמפעילה תהא רשאית לא לספק לו יותר את המוצר, זאת מבלי שהמזמין יהיה זכאי להחזר כספי כלשהו.

4.8.                   אופן אריזת המוצרים ייעשה לפי שיקול דעתה של המפעילה, ולמזמין לא תהיה כל טענה נגד המפעילה בשל כך.

4.9.                   יובהר כי אופן העברת הקורסים יהיו לפי תכנית שתופיע באתר, אך המפעילה תהא רשאית, לשיקול דעתה, לשנות את תנאי ו/או אופן העברת הקורס ו/או את סילבוס הקורס לפי שיקול דעתה.

4.10.               על המשתמש לבדוק מה משך הזמן שאליו תינתן לו גישה לקורס, כאשר יובהר כי לאחר המועד הנקוב או בכל מועד אחר שתקבע המפעילה, גישתו לקורס תיסגר.

 5.             שינוי וביטול הזמנה, ביטול עסקה והחזרת מוצרים

5.1.                   מדיניות החזרת המוצרים וביטול העסקאות של המפעילה הינה בכפוף להוראות הדין לרבות הוראות חוק הגנת הצרכן תשמ"א-1981, והמזמין רשאי לבטל את הזמנתו ו/או להחזיר את המוצרים שהגיעו אליו בכפוף להוראות שלהלן.

5.2.                   שינוי או ביטול הזמנה על ידי המזמין יתאפשרו בהתאם להוראות הדין ובהתאם לשיקול דעתה של המפעילה ובכפוף להוראות שלהלן.

5.3.                   ביטול עסקה והחזרת מוצרים בגינה יכול וייעשו תוך תקופה של עד 14 יום ממועד קבלת ההזמנה. לצורך ביטול העסקה על המזמין ליצור קשר עם המפעילה ולהודיע על רצונו לבטל את העסקה. לאחר קבלת הודעת הביטול של המזמין וככל וזו תיעשה במועד האמור, תתאם המפעילה עם המזמין את דרך החזרת המוצר. יובהר כי באחריות המזמין לדאוג להחזרת המוצרים למפעילה וכי החזרת המוצרים כאמור תיעשה על חשבון המזמין.

5.4.                   עם קבלת המוצרים שהוחזרו אצל המפעילה ובכפוף לבדיקתה את מצב המוצרים בעת החזרתם ואישורה בנוגע לתקינותם, תחזיר המפעילה למזמין את כספו בגין ההזמנה. המפעילה תהא רשאית, לפי שיקול דעתה ובכפוף להוראות הדין, לגבות דמי ביטול בשיעור של עד 5% מערך ההזמנה או 100 ₪, לפי הנמוך מבין השניים, כאשר שיעור דמי הביטול כוללים את דמי המשלוח ככל ואלה נגבו, זאת בנוסף לעמלות סליקה ששולמו בפועל. הוראות סעיף זה בעניין דמי ביטול לא יחולו על ביטול שנעשה מחמת פגם במוצר שהוזמן בהתאם להוראותחוק האחריות למוצרים פגומים, תש"ם-1980ו/או אי התאמה בין תכונות המוצר כפי שמופיעות באתר לבין תכונות המוצר בפועל, שאז לא ייגבו דמי ביטול מהמזמין, זאת בכפוף לבדיקת המפעילה את טענות המשתמש בדבר אי התאמה ו/או פגם, בהתאם לעניין.

5.5.                   יובהר כי לא ניתן לבטל עסקה ולקבל החזר כספי בגין ביטול עסקה לרכישת קורס דיגיטלי ככל וכבר ניתנה גישה לקורס; והכל בכפוף להוראות הדין לרבות חוק האחריות למוצרים פגומים, תש"ם-1980.

5.6.                   המפעילה מדגישה כי על המזמין לבדוק כי המוצרים אשר קיבל לידיו תואמים את פרטי ההזמנה כפי שזו נעשתה על ידו. ככל וישנה אי התאמה בין המוצרים שהוזמנו למוצרים שהתקבלו בפועל (למשל הכמות שהתקבלה אינה תואמת את הכמות שהוזמנה), על המזמין להודיע למפעילה תוך שני ימי עסקים לכל היותר על אי התאמה כאמור. ככל והמזמין לא הודיע למפעילה במועד האמור, יראו את המזמין כמי שאישר כי קיימת התאמה בין ההזמנה למשלוח ולמזמין לא יהיו טענות נגד המפעילה בשל כך.

5.7.                   בכל הנוגע לביטול עסקה לרכישת קורס שאינו קורס דיגיטלי אשר הגישה מתקבלת אליו מיד לאחר הרכישה, ככל וטרם התחיל הקורס ו/או ככל וטרם התקבלה גישה לקורס, המזמין זכאי לבטל עסקה בתוך ארבעה עשר יום ממועד ביצוע העסקה, ובתנאי שביטול כאמור ייעשה לפחות שני ימי עסקים לפני המועד שבו אמור הקורס להתחיל ו/או לפני קבלת פרטי גישה, המוקדם מהשניים. יובהר כי בחלוף אחד מהמועדים שלעיל למשתמש לא תהיה זכאות לקבלת החזר כספי בגין בקשה לביטול קורס, והכל בכפוף להוראות הדין והוראות תנאי שימוש אלה.

 6.             אחריות והיעדר אחריות

6.1.                   המפעילה מקפידה כי המוצרים המוצעים על ידה למכירה באתר יהיו באיכות גבוהה. עם זאת יובהר כי המוצרים המוצעים למכירה באתר אינם מיוצרים על ידי המפעילה (למעט אם צוין במפורש אחרת) ולכן בכל פגם ו/או בעיה שיש במוצר אזי על כל טענה ו/או תביעה ו/או דרישה של המשתמש להיות מופנית ליצרן של המוצר, הכל בכפוף להוראות כל דין ולמעט אם צוין במפורש אחרת.

6.2.                   באתר ו/או בקורסים מופיעים תכנים שונים לרבות, אך לא רק, תכנים והמלצות בנוגע לשימוש במוצרים המוצעים למכירה באתר וכן עצות ותרגילים המופיעים בקורס. יובהר כי המפעילה אינה אחראית לכל שימוש של המזמינים במוצרים אלו ו/או לכל שימוש בהמלצות השונות ו/או בכל הנוגע ליישום הידע שנלמד בקורסים. יובהר כי אין לראות במידע המוצג באתר משום המלצה מחייבת וכי יש להתייעץ עם גורם מקצועי המוסמך לכך טרם השימוש במוצרים הנמכרים ו/או בהמלצות השונות. כמו כן, יש לעיין בעלון לצרכן, ככל וישנו, טרם השימוש בכל מוצר למשתמש לא תהיה כל טענה נגד המפעילה בגין כל נזק שייגרם לו ו/או לכל צד שלישי בגין שימוש במוצרים אלה. כמו כן למשתמש לא תהיה כל טענה בגין הסתמכותו על המידע שפורסם באתר ועל כך כי כפועל יוצא מכך לא עשה שימוש במקורות מידע אחרים.

6.3.                   המפעילה לא תישא באחריות לכל נזק ו/או פגיעה ישירים ו/או עקיפים מכל סוג שהוא שייגרמו למזמין ו/או לצדדים שלישיים כתוצאה משימוש ומהסתמכות על התוכן המופיע באתר.

6.4.                   המפעילה אינה אחראית לכל השלכה רפואית או בריאותית הנובעת מהשימוש במוצרים הנמכרים באתר ו/או מיישום התכנים המופיעים באתר ו/או בקורסים. המשתמש מתחייב, בכל מקרה של ספק ו/או צורך אחר, לבדוק את התאמת המוצר והתוכן לצרכיו האישיים ולהתייעץ עם גורם מוסמך לפני השימוש במוצר. המפעילה לא תישא באחריות לכל נזק, ישיר או עקיף, שייגרם למשתמש כתוצאה מהשימוש במוצרים שלא לפי הוראות היצרן.

6.5.                   המשתמש מאשר כי ידוע לו כי המפעילה אינה מתחייבת כי רכישת הקורס והשימוש בכלים ו/או בידע שרכש בקורס יגרמו לו להצליח בהתאם לציפיותיו, והצלחת המשתמש ביישום התכנים שלמד בקורס תלויה במדדים שאינם בהכרח תלויים במפעילה לרבות, אך לא רק, יכולת למידה עצמית, התמודדות עם לקויות למידה, משמעת עצמית הנוגעת ליישום שיטות ותרגילים שנלמדו בקורס ועוד.

6.6.                   המפעילה עושה כל מאמץ על מנת לוודא כי המידע על המוצרים המופיע באתר יתאים למוצר הנמכר. עם זאת לעתים ייתכנו טעויות בתום לב בנוגע לפרטים ולמידע על המוצרים כפי שאלה מופיעים באתר, ועל כן טרם צריכת המוצר יש לקרוא בעיון את פרטיו של כל מוצר. ככל ובתום לב סופק לכם מוצר אשר אינו תואם את תיאורו באתר, ביכולתכם ליצור קשר עם המפעילה אשר תדאג לזיכוייכם בגובה מחיר המוצר שנרכש ותתאם את החזרתו של המוצר למפעילה. לחלופין ניתן גם להחליף את המוצר במוצר אחר ולקבל זיכוי ו/או להוסיף סכום נוסף בהתאם להפרש בין המוצר שהתקבל למוצר החלופי.

6.7.                   המפעילה אינה מתחייבת כי הקישורים המצויים באתר, ככל ואלו יופיעו, יהיו תקינים ו/או יובילו לאתר אינטרנט פעיל. הימצאותו של קישור לאתר מסוים באתר של המפעילה אין משמעו כי תוכן האתר הינו מהימן ו/או מלא ו/או עדכני והמפעילה אין כל שליטה על תוכן כאמור, ועל כן המפעילה לא תישא בכל אחריות בקשר לכך.

6.8.                   המפעילה אינה אחראית לכל נזק שייגרם למזמין כתוצאה מרכישה באתר לרבות, אך לא רק, מקרים בהם הרכישה לרבות התשלום בגינה מתבצעת שלא בהסכמתו ו/או בידיעתו של המזמין ו/או הקלדה שגויה של כתובת למשלוח ההזמנה ו/או הקלדה שגויה של פרטי כרטיס אשראי; וכן מקרים של תקלה בתקשורת עקב מעשה ו/או מחדל של ספקי תקשורת.

6.9.                   המפעילה אינה אחראית לכל נזק שייגרם למזמין ו/או לצדדים שלישיים כתוצאה משימוש במוצרים זולת מקרים בהם המוצר היה פגום עקב רשלנות של המפעילה. במקרה זה גובה האחריות של המפעילה יהא מוגבל ולא יעלה על גובה סכום המוצר הפגום שנרכש.

6.10.               אין המפעילה אחראית על תוכנן של מודעות פרסום או הצעות מסחריות של צדדים שלישיים אשר עשויים להופיע באתר. כל טענה, תביעה או דרישה מצד משתמש בגין הצעות, מוצרים או שירותים כאמור, קבלתם או תוצאותיהם יופנו על ידו במישרין אל הצד השלישי, שממנו קיבל את ההצעה או קנה את השירות, ולא תהיה לו בגינן כל תביעה או דרישה כלפי המפעילה ו/או מי מטעמה.

6.11.               יודגש כי באחריות המשתמש לוודא כי ברשותו ציוד קצה וחיבור אינטרנט שיתאימו לצפייה בקורס, והמפעילה לא תהיה אחראית לכל תקלה שמקורה בציוד קצה ו/או בחיבור של המשתמש.

 7.             דיוור ישיר

7.1.                   המפעילה עשויה להציע למשתמשים באתר להצטרף לרשימת התפוצה של המפעילה על מנת להציע להם וליידע אותם בדבר מבצעי מכירות באתר, פרסומים, חידושים, הטבות אישיות ועוד הודעות שיש בהן כדי לעדכן את המשתמשים בדבר פעילות המפעילה ושירותיה השונים, לרבות באמצעות הודעות דוא"ל ומסרונים (להלן: "דיוור ישיר").

7.2.                   למען הסר ספק יובהר כי ההוראות בעניין דיוור ישיר הינן בכפוף להוראות הדין לרבות הוראות חוק התקשורת (בזק ושידורים), תשמ"ב-1982.

 8.             קניין רוחני

8.1.                   כל זכויות הקניין הרוחני, לרבות הזכויות המוסריות, הזכויות הכלכליות, זכויותהיוצרים, סימני המסחר, שמות מסחר, פטנטים, מדגמים, סודות מסחרייםוכל זכות אחרתביחס לספרים ולקורסים לאתר לרבות, אך לא רק, התוכן, העיצוב, העריכה וכן אופן הצגתו ועריכתו של המידע המופיע באתר והאתר עצמו שמורות באופן בלעדי למפעילה. למען הסר ספק, רכישת קורס דיגיטלי מקנה רשיון שימוש פרטי בלי ניתן להעברה לצפייה בקורס ולא את הזכויות עצמן אשר יהיו בידי המפעילה ו/או מי מטעמה.

8.2.                   מבלי לגרוע מהאמור לעיל, האתר, הדפים המקוונים הכלולים בו, הסיווג, הסידור וההצגה של המידע, המודעות והדיוורים שנשלחים על ידי המפעילה, לרבות סיווג, סידור וההצגה של המידע והמודעות המופיעים בהם וכל צורת המחשה אחרת הכלולים באתר ובדיוורים כאמור הנם בבעלותה הבלעדית של המפעילה.

8.3.                   אין להעתיק ו/או לשעתק ו/או לשכפל ו/או להכין יצירות נגזרות ו/או לשנות ו/או להתאים את הקורס, הספר ואת תוכן האתר במלואו או בחלקו לצורך הפצה, פרסום, הצגה, ביצוע, העברה, שידור, העמדה לרשות הציבור, מכירה ו/או כל פעולה אחרת ללא קבלת אישור בכתב ומראש מהמפעילה. יובהר כי רכישת קורסים באתר מעניקה למשתמש רשיון שימוש אישי בלבד שאינו ניתן להעברה ואינו מיועד לצרכים מסחריים, ואין בכך כדי להעביר בעלות כלשהי מהמפעילה למשתמש.

8.4.                   המשתמש מתחייב כי לא יפרסם ברבים את התוכן ו/או חלק ממנו, אלא בתנאים המפורטים באתר. כמו כן, מתחייב המשתמש כי לא יפרסם ברבים כל מוצר ו/או פלט של המידע, בין שהוא מודפס ובין שהוא ניתן כקובץ על גבי אמצעים מגנטיים או בכל צורה אחרת וכי לא יעתיק ו/או ישעתק ו/או ישכפל/או יכין יצירות נגזרות ו/או ישנה ו/או יתאים את תוכן האתר במלואו או בחלקו לצורך הפצה, פרסום, הצגה, ביצוע, העברה, שידור, העמדה לרשות הציבור, מכירה ו/או כל פעולה אחרת ללא קבלת אישור בכתב ומראש מהמפעילה.

8.5.                   הבעלות וזכויות הקניין הרוחני בתכנים של צדדים שלישיים, לרבות תמונות אשר מופיעות באתר, הינם הרכוש של בעלי התכנים, ועשויים להיות כפופים לתנאי שימוש של צדדים שלישיים שהעניקולמפעילהרישיון כדין לגבי תוכן כאמור (להלן: "הסכמי צדדים שלישיים"). המפעילה אינה טוענת לזכויות בעלות ואינה נוטלת כל אחריות לגבי כל סוג של תוכן מסוג זה המוצג באתר. המשתמש מאשר כי התנאים של הסכמי צדדים שלישיים כאמור יחייבו אותו בקשר עם שימוש שיעשה בשירות, לרבות כל שינויים עתידיים בהסכמי הצדדים השלישיים.

8.6.                   המפעילה מכבדת את זכויותיהם של צדדים שלישיים ונוקטת בצעדים הנדרשים על מנת שלא להפר כל זכות של צדדים שלישיים. ככל ונפגעו זכויותיו של צד שלישי בתום לב ניתן לדווח למפעילהעלהפרת זכויות קניין רוחני בדוא"ל בפרטים המופיעים בתנאי שימוש אלה.

9.1.                   המפעילה מכבדת את פרטיות המשתמשים באתר. מידע בנוגע למדיניות הפרטיות ניתן למצוא במדיניות הפרטיות המופיעה באתר.

9.2.                   האתר של המפעילה מאובטח באמצעות שימוש באמצעי אבטחה מתקדמים אשר מטרתם להבטיח שימוש תקין וגלישה בטוחה באתר וכן על מנת לשמור על פרטיות המשתמשים. כל המשתמש באתר ובשירותיו מתחייב כי לא יעשה כל פעילות שיש בה כדי לשבש את פעילות האתר לרבות, אך לא רק, גניבת מידע על משתמשים ופריצה של מנגנוני האבטחה של האתר. המפעילה תפעל נגד כל פעילות כאמור בכל דרך חוקית אשר תעמוד לרשותה לרבות חסימת המשתמש מגישה לאתר ונקיטת הליכים משפטיים נגד המשתמש באם יפעל כאמור.

9.3.                   The site may contain links to external third-party sites that are not the responsibility of the operator. The operator does not guarantee that links on the site and/or in mailings and/or messages sent to the user will be correct and will lead to an active website. The presence of a link to a specific site on the site does not mean that the content of the site is reliable and/or complete and/or up-to-date, and the operator will not bear any responsibility in this regard. Without derogating from the above, the operator is not responsible for any damage, indirect or direct, that may be caused to the user and/or his property as a result of using and/or relying on the information and content that appear on the sites that he will reach through or through the use or link existing on the site.

10.            Period and end

10.1.              The Operator may change these Terms from time to time at its sole discretion. The responsibility to keep up to date with such changes lies with the User by accessing these Terms of Use from time to time. Use of the Service at any time constitutes acceptance of the updated and revised Terms, as they were at that time.

10.2.              The operator reserves the right to change or discontinue the service or any part of it on the site, without prior notice. In the event of discontinuation of the service, the operator will not be liable to the user or to any third party for any damage or loss.

10.3.              The provisions regarding intellectual property and disclaimer will remain in effect after the user's use of the site has ended.

 

11.            General , Jurisdiction and Notices

11.1.              These Terms of Use, including the Privacy Policy, constitute the entire agreement between the parties and supersede any prior agreement, proposal or representation, whether written or oral, with respect to its subject matter. No modification, amendment or waiver of any provision of this Agreement shall be valid unless made in writing and signed or electronically confirmed by the party against whom such modification, amendment or waiver is claimed.

11.2.              The information and service are offered to the user as is.AS-IS, and the user agrees and confirms that the operator, its employees, managers, shareholders or anyone on their behalf will not be liable for any damage, direct or indirect, that may be caused to the user and/or a third party related to the user due to the user's use of the information and/or due to the user's reliance on information displayed on the site.

11.3.              These Terms of Use shall be governed solely by the laws of the State of Israel. Subject to the provisions of law, the exclusive place of jurisdiction for any matter regarding these Terms of Use and the use of the Site shall be the Magistrate's Court in the city of Rehovot, and in the absence of subject matter jurisdiction – the District Court in the city of Lod.

11.4.              Any letter sent to the operator will be considered as having arrived at the addressee's address upon sending it by e-mail, provided that the sender has confirmation of delivery from the operator.
